The Liberal Party is known to have businessmen backers throughout the past few national elections. These businessmen are wealthy businessmen who want to have a footing in politics. Some maybe helping for the love of it, but some have hidden agendas like being protected, who knows, but this is just a presumption.

This is after one of the main backer of LP, miner Patrick Angelo "Eric" Gutierrez and Caloocan Rep. Edgar Erice, who is a top honcho of LP are now both facing criminal charges for the alleged falsification of documents in order to dupe the government and their business partners of billions of pesos in mining revenues.

The complaint against Gutierrez and Erice was originally filed at the Surigao Prosecutor's Office and was forwarded to the Department of Justice (DOJ) for preliminary investigations.

The accuser is a small-scale miner from Agusan del Norte, Rodney Basiana. He filed charges against Erice, Gutierrez, John Anthony Gutierrez, Miguel Alberto (Mico) Gutierrez, Alejandro Basalio and Antonio Dimabayu of falsifying a mining application. Basiana claimed that Erice and Patrick Gutierrez forged his mining application to make it appear that it was SR Metals Inc. (SRMI) who applied for a mining permit and in 1997.

In Basiana's accusations, he said that the respondents made it appear that SRMI, which is owned by Erice and the Gutierrez family and is a known backer of Mar Roxas and Noynoy Aquino, was the holder of mining claims over an 81-hectare area in Tubay, Agusan del Norte. In reality, it was Basiana Mining Exploration Corp (BMEC) who held that right.

Basiana said that the Mineral Production Sharing Agreement (MPSA) application executed and signed by Erice on July 7, 2006, “was made with the wrongful intent of injuring and damaging BMEC, my late father, my mother, the other members of the Basiana family and me, amounting to billions of pesos.”

BMEC later instilled their rights to revoke the Deed of Assignment to MMC. On October 18, 2005, BMEC executed a Deed of Assignment that says that SRMI will be favored if they give 5% of gross proceeds.

Basiana claimed that the SRMI refused to honor the commitment to give him 5% of the gross.
